Terms of service

The rules for using Tabsend, in plain words.

The short version

  • Tabsend sends links between your own devices. Use it for that.
  • The extension and apps are free. The hosted service costs $15 a year after a 30-day trial that needs no card. You can also run your own server for free.
  • One person makes Tabsend. Support is by email, on a best-effort basis. There is no uptime promise.
  • Your links are yours. We don't read them. We store and pass along the locked copies, and nothing more.
  • Don't abuse the service. We can pause an account that does.
  • Tabsend is early software. It can delay or lose a link. Keep a copy of anything important.
  • Our liability is limited. Section 11 has the details.

1. About these terms

These terms are an agreement between you and Zinnia Drive LLC, which makes and runs Tabsend. In these terms, "we" means Zinnia Drive LLC. They cover the Tabsend browser extension, the Android and iPhone apps, the web console, tabsend.org, and the hosted Tabsend service, which together we call "Tabsend". If you use Tabsend, you agree to them. If you don't agree, don't use it.

The code has its own licenses. The extension and apps are licensed under Apache-2.0. The server code is under the Functional Source License (FSL-1.1-ALv2). You may run it for yourself, your family or your employer, but not resell it as a competing service, and each release becomes Apache-2.0 two years after it ships. Those licenses decide what you may do with the code. These terms cover how you use the apps and the hosted service. If you run your own server, it is yours to look after, and sections 5, 8 and 11 still apply to you.

Our privacy policy explains what data Tabsend handles. It is part of these terms.

2. Who can use Tabsend

You must be 13 or older. If you are under the age of majority where you live, a parent or guardian should agree to these terms for you. You are responsible for your devices and for everything done with them through Tabsend.

A complete pairing link lets whoever holds it add a device to your group. Treat it like a key. Don't post it or send it to anyone you don't want in your group. Pairing links expire quickly, but until they do, they work.

3. Your account

Your devices need no account. The hosted service does: you sign in with a link we email you, and there is no password. Use a working email address of your own, and keep that email account secure. Anyone who controls it can sign in to your Tabsend account, and cancel or delete it.

4. Trial, price and payment

This section applies to the hosted service only.

  • Trial. Every new account starts with 30 days free. We don't ask for a card.
  • Price. After the trial, the hosted service costs US$15 a year, for up to 30 devices. Sales tax is added where the law requires it.
  • Renewal. You pay through Stripe. A subscription renews every year until you cancel, and we email you before each renewal.
  • Cancelling. Cancel any time from your account page, or by email. The service keeps working until the end of the year you paid for, and you are not charged again.
  • Refunds. Payments are not refundable, unless the law says otherwise. If something on our side stopped Tabsend working for you, email us and we will make it right. That may mean a refund.
  • Price changes. A new price applies from your next renewal, and we email you at least 30 days before.
  • If the trial ends or a payment fails. Your account pauses: sending stops, your devices stay paired, and nothing is deleted. We email you. Pay, and it picks up where it left off. If 90 days pass without payment, we delete the account.

5. What you can't do

Tabsend is for sending links between your own devices. Don't use it to:

  • break the law, or send links to scams, phishing pages or malware
  • send unwanted links to other people, or spam anyone
  • overload, probe or attack the service, or get around its limits, such as the 30-device limit or the rate limits
  • make extra accounts to get more free trials
  • resell the hosted service, or offer it as a competing service
  • harm other people or other people's use of Tabsend

We can't see what you send, so we act on reports and on what we can see, such as how much is sent and how many devices a group has. Report abuse to the address in section 15. If you break these rules, we may pause or delete your account. We warn you first when we can.

6. Your links and your data

Your links are yours. We claim no rights to them. You give us permission to store and pass along the locked copies you send, only as far as needed to run Tabsend.

You are responsible for what you send and for the pages your links point to. We don't control other websites. Links come from your own devices, but a page on the web can still be harmful. Opening it is as risky as visiting any website.

7. Support

One person makes and runs Tabsend. Support is by email, best effort, at no set hours. Replies usually take a few days, and sometimes longer. There is no support contract and no service level agreement.

8. Availability and early software

Tabsend is early software, before version 1.0. We work to keep it secure and running, but no software is perfect, and we promise no uptime. The hosted service can go down for maintenance or by accident.

  • If your server is offline, links wait and are sent when it returns. A link that waits more than 7 days expires.
  • On iPhone, Apple decides when an app may wake in the background, so a link may wait until you open the app.
  • Don't use Tabsend for anything urgent or critical, like emergency messages. Keep a copy of anything important.
  • We may change or remove features.

9. Other companies' services

Tabsend depends on services we don't run: your browser, Apple, Google and Mozilla and their stores and push services, Stripe for payments, and the companies that host our servers. Their terms apply to your use of them. They change and fail in ways we can't control, and we are not responsible for them.

10. Ending

You can stop any time: remove the extension and apps, and delete your hosted account. We can pause or end your access if you break these terms, or if keeping you would put the service or other people at risk.

If we ever shut down the hosted service, we will email you at least 90 days ahead and refund the unused part of any year you paid for. When your access ends, sections 6, 11 and 12 still apply.

11. No warranty, limited liability

Tabsend is provided "as is" and "as available". We make no promises of any kind, stated or implied, including that it will run without interruption or errors, that it is secure, that it fits a particular purpose, or that a link will arrive, on time or at all.

As far as the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, lost profits or lost links. Our total liability for any claim about Tabsend is limited to the greater of what you paid us in the 12 months before the claim, or US$50.

Some places don't allow these limits, so they may not apply to you. Nothing here limits a liability that the law doesn't allow us to limit.

12. Disputes and Iowa law

Email us first. Most problems are quick to fix. Please give us 30 days to work it out with you before you take any formal step.

These terms are governed by the laws of the State of Iowa and the federal laws of the United States, without regard to conflict-of-law rules. If we can't settle a dispute by talking, it goes to the state or federal courts located in Iowa, and you and we both accept those courts. If you use Tabsend as a consumer, this doesn't take away any protection your local consumer laws give you that can't be waived.

13. Changes

When these terms change, we change the date at the top. If a change matters, we email hosted-service users at least 30 days before it starts. If you keep using Tabsend after that, you accept the change. If you don't accept it, stop using Tabsend and cancel.

14. The rest

These terms and the privacy policy are the whole agreement between you and us about Tabsend. If a court finds one part unenforceable, the rest stays in force. If we don't enforce something right away, we haven't given it up. You can't transfer your account to someone else.

15. Contact

The apps are open source under Apache-2.0. The server code is public under FSL-1.1-ALv2: free to run yourself, not to resell as a competing service, and it becomes Apache-2.0 two years after each release.
